1. Who we are

Peek-a-Boo (peek-a-boo.elevateweb.ro) is operated by CIORAN A. RADU-FLORIN PERSOANĂ FIZICĂ AUTORIZATĂ, 48384070, Bucureşti Sectorul 1, Bulevardul BUCUREŞTII NOI, Nr. 136, PARTER, Ap. 5, Romania. Email: [email protected].

2. The service

You upload one photo of a person and choose a Halloween scene. An AI model then creates a short video in which the person in your photo replaces the character in that scene. Each video costs €3.50 including VAT and is a one-time purchase. There is no subscription.

Payment is processed by Stripe through Stripe Managed Payments. Stripe acts as merchant of record for the payment and sends you the receipt. Stripe's terms apply to the payment itself.

3. Your photo: your promises

By uploading a photo you confirm that:

• you are at least 16 years old;
• you are the person in the photo, or you have that person's clear permission to use their image in this way;
• the photo does not show a child under 16, and it contains no nudity or sexual content;
• you have the rights needed to use the photo.

You are responsible for the photo you upload and for how you use and share the resulting video. If you break these promises and a third party makes a claim against us, you agree to indemnify us, to the extent the law allows.

4. What you may not do

You may not use the service or its videos to:

• harass, bully, threaten, defame or humiliate anyone;
• impersonate someone, deceive people or commit fraud;
• create sexual content, or any content involving minors;
• spread political disinformation, or present the video as real footage;
• break any law or anyone else's rights.

We may refuse or delete content that breaks these rules, and we may report illegal content to the authorities.

5. AI-generated content label

Every video is synthetic (AI-generated). It carries a visible "AI generated" label and a matching note in its file metadata, as required by EU transparency rules for AI-generated media (Article 50 of the EU AI Act). You must not remove the label or present the video as authentic.

6. Rights to the video

We grant you a free, non-exclusive, worldwide right to keep, download and share your video, including on social media. The template scenes, design and brand of Peek-a-Boo remain ours. You may not resell the templates or use the service to build a competing product.

You grant us a limited right to process your photo only to deliver your video. We do not use your photo or video for advertising, for AI training or for any other purpose. See the Privacy Policy.

7. Delivery and right of withdrawal

Your video is digital content that is made and delivered right after payment. Before paying, you expressly ask us to start straight away and confirm that you know you lose your right of withdrawal once this starts (Art. 16(m) of Directive 2011/83/EU, as implemented in Romania by GEO 34/2014, Art. 16(m)). After the video has started generating, you can no longer withdraw from the purchase. Your statutory rights in section 8 are not affected.

8. Results, failures and refunds

• AI results vary. The likeness depends on the photo (light, angle, sharpness) and on the scene. We do not promise a perfect likeness.
• If the video cannot be generated, you are refunded in full automatically.
• If the video is clearly defective, for example no face was replaced or the file does not play, email us within 7 days with your video link. We will make it again or refund you.
• Your statutory rights for digital content that does not conform to the contract (Directive (EU) 2019/770) remain unaffected.

9. How long your video is available

Your video can be watched and downloaded for 7 days through its private link. After that it is deleted permanently and cannot be recovered, so please download it.

10. Liability

We are fully liable for intent and gross negligence, for injury to life, body or health, and wherever the law does not allow liability to be limited. For any other damage, our total liability is limited to the amount you paid for the video concerned. The service is provided without uninterrupted availability.

11. Reporting abuse

If you believe a video shows you without your permission, or is otherwise unlawful, email [email protected] with the link. We will review the report quickly and delete content where it is justified.

12. Law and disputes

These terms are governed by Romanian law. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence. You can contact the Romanian consumer protection authority (ANPC, anpc.ro). We are not obliged to take part in alternative dispute resolution, and we do not do so.

13. Changes

We may change these terms in the future. The version that applies to your order is the one shown when you paid.
